Hey Darrah,
You can consider this an FYI or a scoop or whatever. I’ve been nosing around some of the blogs and came across your name. Thought you might be interested to hear the “other side” of the Desi Foxx, “thefoxxs.com” story.
I am one of the guys, S Avalos, that “Desi Foxx” is bashing in all kinds of ways.
Here’s the facts on what is really going on. (at least from our side)
Quick note:
P Hasson and I aren’t “Porn” people. All of this developed because of a mainstream documentary that P Hasson is producing and directing, in which Desi and Elli are a part. I helped him on it for a couple days. In the course of those days, I met Desi and – (because I’m an idiot) decided to help her with her endeavor because putting together websites, DVDs etc. was something I was familiar with. Desi had absolutely no money, and no real knowledge on how to accomplish what she wanted. With an appearance on Howard Stern mere days away, I thought it would be a shame not to have anything to promote or sell. The Stern people were of the same opinion. I thought it might be fun to get involved and thought I could also make a few bucks in the process. I had (and still have) no intention of staying involved with any of it for longer than a couple months.
I thought it would be a win/win for everyone; I leave with a crazy story, and a few bucks while Desi gets a website, some content, a DVD and the start of a small company.
With that “quick” intro complete:
1. Desi’s domain, thefoxxs.com was NOT stolen from her. She knows this and has been clouding or simply lying about a lot of things in order to seem like a victim.
THE DOMAIN NAME IS STILL HERS. The reason that the registrant/tech info is currently in my name is because – well, I am (god I wish I weren’t) the site admin. I had to change the site from her isp (which doesn’t allow adult content) to one that does. The changeover is still in process, though who knows what trouble she is causing. She already once caused an issue which caused the domain to fall into “redemption”. Currently, I couldn’t change the information if I wanted. The domain, thanks to her screwing around, is in some limbo state. If I were able to do anything, the first thing would be to make my whois.net contact info anonymous. Makes sense, right?
Assuming she doesn’t cause more trouble, (haha) the site registrar info will move to the new ISP. If so, it has to stay there for 60 days. A site can’t be shifted more frequently than that. But the domain name is still hers.
2. Since she is unable to pay the most basic of bills, I actually covered the costs of all the transfers, the new web space, etc. That’s actually the main reason that the information is all currently in my name. It had to be, for billing purposes.
I’ll say it again: I AM NOT CLAIMING HER DOMAIN. I seem to be unable to get this through her thick skull – or more likely, it is a more dramatic story for her and her “woes that aren’t ever her fault”.
3. From practically day one, working with her has been a nightmare. She has only the most basic notions about business and had/has a very inflated idea about her worth. This has been the crux of many problems. To be honest, I’ve seen kids running lemonade stands with more business sense than her.
4. P Hasson and I invested quite a bit of our personal money and time into creating the site, shooting content, authoring the DVD, creating merchant accounts, putting duplication and shipping into place. It’s been a death by a thousand cuts situation. What was supposed to be easy and not too pricey has been made neither – by Desi’s actions. For instance: we are the ones that actually take the processed orders and physically pack and ship those damn discs out on a daily basis. This is but one thing that “poor stressed Desi” just hasn’t had to even think about.
5. We are supposedly equal “partners” in this venture. It was not a ‘work for hire’. Her part of the deal was to promote the DVD and website. Haha. Funny, eh?
Like I already wrote, my plan had been – set it up, work it for a while,, maybe a month or two, hopefully make a few bucks – then split and give her everything. So much for that idea.
6. Desi took a great opportunity (the Howard Stern show) and blew it – in a way like I have never seen. I have seen bad business moves, but she takes the cake. Instead of pricing the disc at something reasonable she had very crazy notions about her value. P Hasson and I made the huge mistake of staying at the crazy prices she was demanding for a little while. Unfortunately, rather than a “we tried it your way, now let’s try something else” situation, this gave her a grandiose notion that she was ‘in control’ of the partnership.
6. When the disc wasn’t selling at her exorbitant price and we suggested lowering it, she went into orbit; convinced that we were crooks, thieves, liars and a host of other things. Almost immediately, she went to other people to try to do a side deal. She even wrote about it on her blog. She made no bones about cutting us out, in what would have been an illegal and unethical move. To be honest, we would have been okay with this if she could actually have come up with money to cover our costs. The word “Ethics” and the name Desi Foxx should obviously not be in the same sentence. How she has used Elli to try to get in the spotlight should have been an obvious clue for me on this. Call me a slow learner. Heck, call me an idiot on this one.
Every single potential “investor” that has spoken with us has run in the opposite direction when they become aware of what Desi Foxx is really like. If only I had the same warning before I got involved with her on this thing!
7. When she suddenly decided to “retire”, she left us holding the bag. She never told us about this; she didn’t give a damn what it would mean to us financially. We (P Hasson and myself) are into this for money, time and effort – and she just decided to walk away. At that point, the “contract” (actually a deal memo) had been breached by her in a number of ways. Now she was simply walking away (or trying to do some deal behind our backs, depending on the day). We realized that we had to take the situation into our own hands and do what we could to recoup some of our money. Lowering the price of the DVD was the most obvious thing. The disc simply wasn’t selling at her prices. No rocket science there. However, rather than let us do our best on that – she wanted to stop everything.
In other words, she was saying, “too bad you’ll lose your money, but I don’t want to play anymore. Oh and you can’t play either even though you bought the ball.” Additionally, she wanted (hysterically demanded, actually) everything that we had created for this venture.
8. It should be noted that P Hasson’s company has copyright to all the materials on the site, the DVD, the still photos, etc. of her. She is under the false impression that she has the copyright because of some poor wording in the deal memo we signed (the same one she breached and nullified in so many dramatic ways) Though she does own the domain… the website itself (html code, php code, etc.), the content: the DVD, etc. does NOT belong to her. All the 2257s, model releases, etc. belong to and are in P Hasson’s company name.
9. In spite of her (I believe true) insanity and purely self-centered intents, we (P Hasson and I) STILL have not done anything illegal.
We are maintaining the site as best as possible IN SPITE of Desi. If and when any money is due her, believe it or not – we will actually pay it.
The bottom line is that we are in the midst of a freakin’ nightmare. The woman is a monster and I wish I’d never laid eyes on her.
She is slandering us, she is printing our names. She is causing major “tortious interference” by telling people not to buy the DVD and making claims that there might be credit card fraud involved. She is the worst sort of person – a self centered sociopath who has no compunction about breaking the law and then claiming others are doing it.
This is not mere obfuscation on her part. She is out and out lying about many things. I cannot imagine that even in her severely delusional state that she doesn’t know what she is doing.
The truly frustrating thing about all of this is if we had put together a business venture that didn’t work out after honest effort, I would be bummed — but I would chalk up the losses as something that simply didn’t pay out.
This isn’t what happened here. From day one, Desi Foxx has been shooting us and herself in the feet. She has been the biggest single liability of thefoxxs.com.
It remains my hope to soon get the hell away from her and everything “Foxx” related. Since my name is attached to the domain theoretically for 60 more days, and since I still am trying to recoup some money, it would seem that this has another two months to go.
I wanted to also make clear that this really could have been an instance where a female performer did well.
This time, believe it or not, it is not a case of evil men exploiting a helpless woman.
I hope this serves as some kind of warning to others or at least clarifies some of this idiocy.

I had to edit out her real name because of safety reasons. I think I got it all now. But I kept the rest of the comment as is. You shouldn’t post the real names of porn performers S Avalos. It’s dangerous on their end while your name was already known. I found it in seconds when I first heard about this domain mess.
I have stopped criticizing Desi on my blog after hearing they were having trouble paying their bills and might lose their home. And hearing someone took their domain and content. I don’t know what the story is and who is to blame. My problem with Desi was her doing porn with her daughter. Now the story has shifted and I don’t want to attack two women that are now having all these problems.

It sounds like she’s going buy what the “partners” agreed upon (the “poorly” worded memo) and not what all the extraneous legal doc’s indicated. It sounds like in how yall did business, it wasn’t unusual to have stuff in people’s name even though it didn’t belong to them, e.g., the domain name. It doesn’t sound like anybody was rigorous about clearing delineating lines in the partnership. And, if she was supposed to have such limited control over the DVD, why was she able to dictate the price it was sold at?
There are a couple of other places in your posting that Desi not owning the DVD sounds grey, but you’re not as clear as you are in the above quote.
Desi’s going by the deal memo, you’re going by who’s name the copyrights on the DVD are in. It just sounds like a deal that wasn’t clearly specified.
And, I’m absolutely positive she’s saying something along the lines of she wasn’t the one who nullified the deal first, but you guys by claiming ownership to the DVD.
Just going by basic feel and guessing, this sounds central to the whole issue. I’ve had unstable people do this to me. I say something that I really didn’t even know was controversial. And then, the other person just flies off the hook, declares the fight over, and that I’m a jackass. Meanwhile, I didn’t even get a chance to discuss the issue before I’ve been declared a jackass.
What I don’t think you get is that it was a honest effort. It’s just that Desi Fox is an honest nut case. You made a deal with someone who wasn’t fit to fulfill the deal. And, it sounds like you’ve let her draw you into her nut-quackery, but you’re still walking around thinking how even headed you are.
If you were so prepared to walk away having lost money and just be bummed, why don’t you do that now?
If you just feel burned and feel you should at least be able to cover your costs, how is it Desi’s fault she doesn’t have any money? You didn’t know that going in? She obviously, either rightly or wrongly, believes in this whole effort enough that if she had the money just to hire someone, she wouldn’t have taken on partners.
What you do with people who owe you money, but they don’t have it to pay, is to cut a deal where you get the money in the future. Have you tried this rather than to try to hold the web site and DVD hostage? Maybe with a, formally prepared, contract that gives you your money out of any future proceeds of the DVD?
If you guys are the honest brokers, not engaging in the same hysteria she is, and are making no claims on the web site, only the DVD, why has the web site not been handed over?

well the questions are all moot now… basically all comes down to trying to break even with the crap we got involved with. But Desi’s too much. P Hasson and I are exhausted dealing with her madness.
Like I wrote – the domain is hers, always has been. We’re fed up and she can do what she wants. I bet you’re going to see some website based on a stupid blog template. However, you’re not going to see the content we produced. (I’m sure you’re heart broken)

The most sympathetic way to read your oringal post, the strong arm tactics simply amount to you using her domain for your web site. But, there’s definitely room for arguing you’re strong arming her more than that.
