New information on Kayden Kross’ criminal case: She pays $28,000 in restitution and begged her ex-boyfriend for help.

    Hey,

    I am sort of following the kayden kross story. Nothing to do with her specifically, but rather the principal behind what she did to that (and another) family. I have stayed out of it, as all my info, although close to the source, is still second hand. It’s just unsettling in my stomach sometimes to hear people stick up for her when they have no idea who they are dealing with. But now that her case is over, I just thought I’d let you know a few things not being released. You seem like a good person, and diligent in your research.. So this may settle a few things you’re wondering about. Maybe not. It’s just FYI.

    I don’t want to say too much yet, as Scotts, the mortgage broker, case is still going on, unfortunately. Her ex boyfriend (referred to as obf in I believe Fayners article) has taken a HUGE high road in keeping quiet and not releasing what may have been incriminating documents, and recordings that portray just how vindictive she is (a false police report accusing him of hitting her, and her begging for his help when this all started, for example). He is a prominent business figure now and it could taint his reputation. He has only testified when demanded to do so by the feds, and also on behalf of the family when it became evident the detectives were on the wrong course (and no I am not obf lol).

    I was told that she is to repay the family a sum of 28K. This is the amount she pocketed–separate from her payment for the deal–to pay the family’s monthly mortgage for 1 year. Yes she can argue that “she didn’t know” but when told by the family they were receiving warnings of non-payment, she told them to “f*ck off.” Yep. That was her reaction to a family about to lose their home. She was also warned by others of what she was doing. Her response? “F*ck them.”

    But as far as you are concerned this is here-say. This was really for your curiosity, but should you choose to use this info just say it’s from a close, but undisclosed source. I’m sure Mike South, who jumped on the Kayden bus long before he even met her in person, will be there to ignorantly defend.

    Thank you for this! Can I post this email? I was more concerned with if she would pay restitution and how much. I couldn’t find that in the records I have. You say she has to pay them 28 thousand but didn’t she walk away with over six figures? And who is the other family and why wasn’t she ever charged with that case? Thank you!

    You can post that email, of course. But just be sure to use the word alleged because I can neither find the actual document demanding restitution–of course I haven’t asked for them. I did hear it first hand though from someone in the courtroom at the time of sentencing–but in case anything changed from my last update you don’t need the liability. I am about certain there is no overturning restitution, but I know about nothing about law lol.

    She did walk away with 6 figures, but this was the amount that was supposed to go to the family directly. In the beginning of the case it was all focused on the mortgage broker. It wasn’t until he fought really hard, and needed obfs support, to show it was truly her that went back on the contract. But by this time the way in which the court set up the trial it was too difficult to drop his case.

    One example in how the system is messed up. That is actually why I was told the court kept prolonging the case–to try and find a way to take him off. His case is still going on. You can look him up as william henley on sacramento courts. So if you don’t mind holding off on this info. I have no idea if it will effect his case or not. He really does not deserve this. I actually follow this case to know the outcome for the family, but his outcome most of all. I am appalled she is willing to put all the blame on a man she knows full well is not guilty of this. It could be years in prison for him. Disgusting.

    The other family charges were not brought up. All I know is that they decided to move on and didn’t file a complaint to start the investigation. They very well could have though.

    I wanted you to have more info because I read how Mike has threatened defamation, or whatever, but it’s only defamation if the info isn’t true–which everything you posted thus far has been, maybe side from a few little minor details. And you are not dealing with some distant source. Mike is a distant source. He gets his info from a criminal, I get mine from the courts and visible documents. So don’t worry about him lol.

    Anyways, when I find out more you’ll be the first to know. Just leave out this emails’ info about scott. I don’t know if that is good for his case to get out, or if it matters at all. Just a precaution.

    The people on the other end don’t want to have their name mixed in with that of a porn girl, so they’re keeping out of it. I personally am too appalled to keep quiet. My gut told me to write you.

    I still don’t understand the reasoning behind why she only pays $28,000 but she did walk away with over six figures that was never hers. Is that her cut of what she has to pay back while the other accomplices will also pay the same cut?

    Do you know if she’s already paid the amount or will it be like how many crminals never pay and it’s held up in court for years? She has the money for her new horse and her new apartment but not enough to pay the family?

    I’m willing to bet they’ll end up with the money from her. She is a “money hoarder” according to someone who knew her well and it’s likely right there in her account. I’ll hear about it if it is, or isnt, paid down the road.

    Yes there’s more money involved, especially combined with the other family. The 28k was just the most obvious in contract agreement that she would owe; that was never supposed to be hers. The exact numbers and details are I believe in one of Scott Fayners articles. I was surprised to see it written about so well and exact. But to dig up the other figures in the investigation would have required more research and effort on the prosecuting side. I seriously don’t think the detectives did a great job at researching this, particularly in the beginning of the investigation.

    When her obf was interviewed by the detectives he said the detective sounded more enamored with her than anything.. Much of the info against her in paperwork/interviews from others, mysteriously disappeared, until forced upon them to acknowledge it. Long complicated story, but it was an unjust mess to say the least. So in my personal assessment, the reason she is getting a slap on the wrist is because the investigation in the beginning was weak, only strengthening toward the end when it was too late to really go after her.

    It would have to had gone to trial, expensive for everyone, so they offered an easy deal. Now they can move on to their next case. But it was told to me that there were no taxes paid on this income, so IRS could get involved if given a heads up. This is where some certain people are taking a high road and not sending in her bank statements with those years taxes that is all on their computer. She is really fortunate in this.

    The other guy–the one she went in on this with-is no where in sight. I don’t think he signed anything; it was Kims (Kaydens) stripper income this was all based on to qualify her. Why he is not involved is a whole other story. Based on my info he wont be paying restitution. That part is not entirely fair to her, but at least deservingly.

    I hope I answered most of your questions. When the mortgage brokers trial is done I’m sure I’ll have more. I am now hoping he wont be going to jail for something she did.

Mark Kernes from AVN left this comment last night on my blog. Sorry that it was held in comment moderation for some reason:

    Near as I can tell, Ross and Fayner didn’t do ANY interviews of the occupants of the house regarding this case; all they did was print or link to what you wrote. If you’ve got some facts (as opposed to rumor or speculation), trot them out.

I never interviewed the people involved in this case and wouldn’t even know where to find them or what their names are. I only know the broker’s name. Everything I know about thew victims in this case are from the interviews Scott Fayner and Gene Ross did throughout this past year.

Kayden never spoke and it took her and her handlers a year to come out with their spin and story. Probably reading the blogs and forums to see what her fans were saying so to incorporate it all into what she told you in your interview with her.

Many of her supporters blamed everyone involved from the man who lost his home, to the mortgage broker, and to the ex-boyfriend. She blamed the ex-boyfriend for stealing her dog. But it was Kayden who broke into his home and stole his dog. He was later contacted when his dog was later found. While the mortgage broker took in the entire family out of his own pocket and gave them a place to stay after they lost their home. Now he’s facing his charges when the family can’t understand why he was ever arrested.

I’m sorry for everything I said about you. I was just angry how once again Kayden is being portrayed as the victim and did nothing wrong. If anyone thinks this apology means someone got to me, then think again. Mark’s comment is the only contact I have gotten from him and no lawyers have contacted me either. The only way a story will get pulled here is if WordPress does it themselves. And if I apologize, which I’ve only done once before here, it’s because I felt it should be done.

I’m just upset how so many in this industry turn a blind eye to crime. Many of my family members are one check away from losing their homes. My father also lost his job two years ago and still can’t find a new job. Thankfully my mother still has her job but they have to be more careful now.

These are some of the interviews that I can quickly find. Scott Fayner interviewed the man who lost his home and so did Gene Ross. Gene interviewed Kayden’s ex-boyfriend. He also interviewed the mortgage broker who was also arrested for some unknown reason.
